Wills

Your will is your opportunity to ensure that your family is provided for, or your property is distributed in accordance with your wishes once you die. If you do not have an effective Will at the time of your death, your property will be distributed in accordance with Intestacy laws. Preparing a Will helps to provide you with peace of mind – knowing that you have planned for your legacy to continue as intended.

 

We also provide advice and assistance with Estate Planning – Testamentary Trusts, or Family Provision claims.

 

Our legal fees for preparing Wills and Spousal Wills are generally fixed-fee. However, if a Will is more complex than a standard Will, or if our clients require specialist advice on Testamentary Trusts or aspects of Superannuation, we will provide a fee estimate that reflects the time spent answering your questions and achieving the outcome wanted.

Probate & Estate Administration

We provide legal advice and assistance to Executors or Administrators of deceased estates to assist them in carrying out their duties in accordance with the law. If you have been appointed as an Executor or if you would like to apply for Letters of Administration where there is no Will or the appointed Executor is no longer able to act, we can assist you by:

  • Advising you on your rights and responsibilities as an Executor or Administrator;

  • Preparing your Application for a Grant of Probate or Letters of Administration;

  • Liaising with third parties about the assets and liabilities of the estate;

  • Bringing in the assets and paying the deceased’s debts and liabilities;

  • Distributing the estate in accordance with the Will or Intestacy Rules; and

  • Finalising the Estate.

Our legal fees for Estate and administration matters are generally charged at an hourly rate; however, we can provide fixed-fee costs for certain aspects of the process.
