You have the right to choose who can make decisions on your behalf in relation to legal, financial, medical and day-to-day lifestyle decisions when you are unable to do so for yourself. You can do this with Enduring Power of Attorney/Guardianship documents.

Power of Attorney & Guardianship

If you lose your legal capacity and you do not have Enduring Power of Attorney/Guardianship documents, the Court may choose who will make these decisions for you. We can help to ensure that the decisions you can no longer make for yourself are made by those whom you trust.

Enduring Power of Attorney/Guardianship documents are legal documents which give powers to your attorney/guardian to make legal and financial or medical treatment and lifestyle decisions for you when you do not have legal capacity.

There are three types of Enduring Power of Attorney/Guardianship documents we can prepare for you:

  • Enduring Power of Attorney (Medical)

Your attorney has the power to make medical treatment decisions on your behalf.

  • Enduring Power of Attorney (Financial)

Your attorney has the power to make legal and financial decisions on your behalf.

  • Enduring Power of Guardianship

Your guardian has the power to make day-to-day lifestyle decisions on your behalf such as, where you should live, who you can visit and who can visit you, and assisting you with your health care decisions.

We usually charge a fixed-fee for Power of Attorney/Guardianship documents. If your Powers of Attorney requirements are more complex, we will discuss an estimate of our additional fees with you.
